The Supreme Court has dismissed the Ghana Independent Broadcasters Association, GIBA’s case with the National Communications Authority, NCA and Attorney General over NCA’s decision to introduce conditional access to free-to air TV broadcast.
A Seven-Member Panel of the Supreme Court presided over by the Chief Justice; Kwesi Anin Yeboah in a unanimous decision Tuesday, June 23, dismissed the case stating that the applicant did not properly invoke the original jurisdiction of the Apex court.
NCA’s Lawyer, Gary Nimako also said he pointed out from the onset that it was premature for GIBA to have gone to court over the conditional access to -free-to-air TV broadcast matter. But, Counsel for GIBA, Kweku Owusu Agyeman in an interview with GBC’s Rebecca Ekpe says although it respects the decision of the Supreme Court, GIBA will go back to court, as soon as the government begins implementation of the Conditional Access to free to air TV Broadcast policy, because Tuesday’s judgment was not on the substantive matter, and that merits of the case are yet to be determined.
