An Accra High Court has ordered the Chief Executive of the Public Procurement Authority, (PPA) to produce before the Court all letters written by Ghana Cocoa Board, (Cocobod), to sole source fertilizers and also all letters written by the PPA in connection with litovit fertilizer during the tenure of Dr. Stephen Kwabena Opuni as Chief Executive Officer.
PPA is also to make available all letters written by it on litovit fertilizer between 2013 and 2016 when Dr. Opuni was the Chief Executive.
The order also required Cocobod to furnish the Court with all letters written by it through the former Chief Executive to sole source fertilizers. Both institutions are to comply within seven days of service on them.
Justice Clemence Honyenuga made the order after lawyer for Dr. Stephen Kwabena Opuni told the Court prosecution was not forthcoming with the documents after the court had issue a similar order about a year ago.
Samuel Cudjoe told the Court that since issues on procurement had been raised in the matter, those letters from both the Public Procurement Authority and CocoBod were vital to his cross-examination of the witness.
Chief State Attorney Evelyn Kelson told the Court, that prosecution had done its part by furnishing defense with all necessary documents they intend relying on in Court.
She however, suggested the court made an order on both institutions to produce the said letters before the court.
