An Accra Circuit Court hearing the publication of a false news case against Dancehall artiste, Charles Nii Armah Mensah popularly known as Shatta Wale and three others, has ordered the prosecution to release the accused person’s mobile phones to them.
This comes after a heated argument between Counsel for the accused persons, Jerry Avernorgbo and the prosecutor, Chief Inspector Dennis Terkpetey over the mobile phones. Counsel for the accused person told the Court that his clients confiscated belongings are still with the Police. He prayed the Court to order the prosecution to release the mobile phones.
Counsel argued that the offences for which his clients were in court could be accessed by the Police on social media hence there was no need for them to confiscate their mobile phones. Counsel further argued that his clients depend on the mobile phones for survival; hence keeping the phones is an infringement on their rights. Chief Inspector Terkpetey opposed the application arguing that the prosecution needs the phones for further investigation.
However, the presiding Judge Emmanuel Essandoh, said the alleged offences are on social media and it is also known that there’s privilege to access information. He, therefore, ordered the release of the mobile phones to their owners. The Court later adjourned the case to the 7th of next month.
The Court also adjourned the case of ‘fire arm display’ against Ghanaian rapper, Samuel Adu Frimpong also known as Medikal, to the 7th of December, 2021.
