Ghanaian Lawyer, Maurice Ampaw, has revealed that a Will is highly confidential due to its contents.
He revealed this on the GTV Breakfast Show on Friday, May 27, 2022.
A Will or testament is a legal document that expresses a person’s wishes as to how their property is to be distributed after their death and as to which person is to manage the property until its final distribution.
According to Mr. Ampaw, “confidentiality by law starts from how that information you had from your client”. He added that a Will is anything you put out there that is an intention to determine how your affairs and property will be shared after your death.”
Again, he said, “there are three different types of Will namely the Customary Will, that is those inherited from our forefathers, then the Wills Act, which is more formalized and structured which looks at who can make a Will, at what age and also the language to use when making a Will.”
Lawyer Ampaw, again, explained that individuals must make sure to dispose of their self-acquired property only.
Now the Armed Forces Will, he said deals with the armed forces who can die at any time, during war.
He concluded that once a Will document is opened in the presence of the interested parties, it is no more a Confidential Document.
