Henry Nana Boakye Sues Attorney General Over Presidential Directive on Public Service Appointments

Henry Nana Boakye, National Organizer of the New Patriotic Party(NPP) has filed a lawsuit at the Supreme Court of Ghana challenging a directive from the Office of the President ordering the annulment of all public service appointments and recruitments made after December 7, 2024.

The suit, filed against the Attorney General and Minister for Justice, argues that the directive—dated February 10, 2025, and signed by the Chief of Staff—is unconstitutional. Boakye contends that the Chief of Staff lacks the authority to issue such an order, making it a violation of Article 191(b) of the 1992 Constitution, which protects public servants from unjust dismissal.

In his statement of relief, the plaintiff is seeking a declaration that:

1. The directive from the Chief of Staff is unconstitutional and lacks legal basis.

2. Any annulment of appointments based on the directive is unlawful.

3. The President has breached constitutional provisions by issuing the directive.

4. A court injunction should be placed on all government institutions to prevent them from implementing the directive.

Boakye, represented by Sarkodie Baffour Awuah & Partners, is also requesting the court to order the Attorney General to cover the cost of court expenses and legal fees.

The case, which is expected to draw national attention, could have significant implications for public service employment and the powers of the presidency in Ghana.
