CPP Vice Chairman in Court to restrain Party Chairperson from holding Office

Vice-Chairman of the CPP Onzy Kwame Nkrumah has filed an interlocutory injunction at the Accra High Court to restrain Chairperson of the Party, Nana Sarpong Nkumankuma from performing her leadership duties.

In a statement of the case, Mr. Nkrumah said on August 22, 2020 the CPP held a National Delegates Conference in the 16 regions of the country to elect its national executives. He said he won the Vice Chairperson position convincingly with the highest votes cast, while the Chairperson secured only 43% of the total votes cast nationally, which was short of the constitutional requirement of the party’s 50 % plus one minimum requirement.

Mr. Nkrumah contends that with this constitutional deficiency, Madam Kumankuma still carries herself as having won the said elections. It is the case of Mr. Nkrumah that Madam Kumankuma never won the elections and cannot, therefore, hold herself out as an elected Chairperson of the CPP.

The Plaintiff contends that the conduct of the defendant is misleading, as right-thinking members of society will engage her as such, and that can be very detrimental to the reputation and interest of the party.

He is therefore praying the court to declare that Madam Kumankuma having obtained the said votes has not been validly elected as the Chairperson of the CPP and cannot carry out any executive function.

Lawyer for Madam Kumankuma, George Ankomah Mensah told the Court that, they have filed an application to set aside the interlocutory injunction. The case has been adjourned to April 4, for hearing of the said application filed by lawyer for Madam Kumankuma.
