Dafeamekpor sues Speaker over vacancy seats in Parliament

Rockson-Nelson Etse Kwami Dafeamekpor the Member of Parliament representing the South Dayi constituency in the Volta Region is the latest to sue Speaker and parliament seeking declaration that, the sacked MPs have no right to enter the Chamber should the house resume Thursday, 7 November, 2024 as announced by The Speaker of the House.

He is in court to restrain the Speaker from recalling Parliament for the fact that, pending processes before the Supreme Court must be determined fully before, any action as he seeks “a declaration that recalling Parliament while the status of the said four ex Members of the 8h Parliament of the 4th Republic remains undetermined by pending processes before the Supreme Court and High Court would be unlawful and illegal”.

A declaration that any post 17th October 2024 composition of the 8 Parliament of the 4th Republic with the said four ex-Members of Parliament is unlawful.

Lawyer Rockson-Nelson Dafeamekpor is also seeking a declaration that any parliamentary proceedings involving the said four ex-Members of the 8th Parliament of the 4 Republic is unlawful and illegal. As he argued that. “a declaration that pursuant to the Constitution of Ghana, 1992, Article 99(1)(a), it is the High Court which has the sole jurisdiction to hear and determine all”.

For the service on the defendant (The Speaker) in the suit date 31st October, 2024 sought an order directed at the Defendant to ensure that “Mr, Andrew Amoako Asiamah, Member of Parliament for Fomena; Mrs Cynthia Mamle Morrison, Member of Parliament for Agona West: Mr. Kwadwo Asante, Member of Parliament for Sunum: and Mr. Peter Yaw Kwakye-Ackah, Member of Parliament for Amenfi Central, no longer have access to the chamber of Parliament to participate in parliamentary proceedings”.
