Supreme Court strikes out portions of Asiedu Nketia’s statement

The Supreme Court has expunged some paragraphs from the witness statement of the General Secretary of the NDC, Johnson Asiedu Nketsia describing them as offensive to the law.

Mr. Asiedu Nketsiah is the first witness for the Petitioner in the election petition, John Mahama.

Counsel for President Akufo-Addo, Akoto Ampaw raised objections to some paragraphs in the witness statement of the first witness.

He submitted that those paragraphs are not based on the petitioner’s pleadings, and are scandalous, prejudicial and should therefore be struck out by the court.

Following submissions from the parties in the election petition, the court proceeded to rule on the objections.

The Court ordered that paragraphs 6 and 7 be struck out since the witness cannot testify to them because they are not in his knowledge. It also said those paragraphs could have been admitted if the Petitioner was testifying himself.

Paragraphs 25, 26, 28, 30 were also struck out because the court held that they had no foundation in the petitioner’s pleadings. Paragraph 37 was described by the court as just an inference and not evidence and was also accordingly expunged from Mr. Asiedu Nketsia’s witness statement.

The court however maintained paragraphs 21, 32, 33 since they are based on the pleadings of the Petitioner.
